Our firm has had experience with a wide variety of both domestic and international commercial arbitration institutions as well as ad hoc arbitrations.

Institutional experience of our lawyers includes the Mexico City National Chamber of Commerce (CANACO); the Mexico Arbitration Center (CAM); the International Chamber of Commerce; the American Arbitration Association and others.

 

The services we provide include drafting arbitration clauses, the selection of arbitrators, the drafting of pleadings, and the representation of our clients in domestic and international arbitration proceedings.

Also, the attorneys of Rubio Villegas have experience in representing clients in the enforcement of foreign awards in Mexico.


Investor-State Arbitration

The insertion of Mexico in the global economy and the growth of foreign direct investment (FDI) from the US, Europe and Asian countries as a result of structural reforms, such as deregulation and privatizations, have brought numerous investment disputes. Bilateral Investment Treaties such as NAFTA Chapter 11 foresee remedies for foreign investors to resort to arbitration against the Mexican government. In this regard, our firm has provided counsel to international clients seeking redress against discriminatory measures taken by the Mexican government, including claims for expropriation, denial of national treatment and denial of most-favored nation treatment.


Mediation

If a dispute arises, our attorneys advise our clients to address it through the use of mediation, prior to submitting a claim to arbitration, in order to avoid litigation costs and time-consuming proceedings. Our attorneys are knowledgeable of the mediation rules of several mediation institutions including the Mexico City National Chamber of Commerce.
